1. Acceptance of Terms
By visiting our website and subscribing to our newsletter, you agree to comply with and be bound by these Terms and Conditions and acknowledge our Privacy Notice. If you do not agree, please do not use our website.
2. Use of the Website
You agree to use our website for lawful purposes only.
You may not use our website to distribute or transmit any harmful, unlawful, or offensive materials.
3. Intellectual Property
All content on this website, including text, logos, and graphics, is owned by ANANDAYA or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.
4. Newsletter Subscription
By subscribing to our newsletter, you consent to receive emails from us. You may unsubscribe at any time by clicking the "unsubscribe" link in our emails or contacting us directly.
5. Limitation of Liability (Website)
ANANDAYA is not responsible for any damages arising from use of the website or newsletter. Your use of the site is at your own risk. For clarity, this Section applies only to website and newsletter use. All liability relating to Experiences is governed by Sections 6–13.
6. Third-Party Experiences & Marketplace Disclaimer
6.1 Curated Marketplace Only.
ANANDAYA operates solely as a curated marketplace showcasing retreats, wellness destinations, and related experiences (collectively, “Experiences”) offered by independent third-party providers (“Providers”). We do not own, run, control, or manage any Provider or Experience.
6.2 No Agency or Partnership.
Listing an Experience on anandaya.co — or facilitating an introduction or booking — does not create any agency, partnership, joint venture, employment, or fiduciary relationship between ANANDAYA and any Provider or guest (each, a “Guest”). All agreements, payments, and responsibilities rest exclusively between the Guest and the Provider.
6.3 No Endorsement or Warranty.
ANANDAYA does not endorse, guarantee, or make any representation or warranty, express or implied, about the legality, quality, safety, suitability, or availability of any Provider or Experience, including accommodations, transport, activities, or wellness services, except where such warranties cannot be excluded under applicable law. Experiences are not a substitute for professional medical advice; Guests should consult a qualified physician before participation.
6.4 Substance-Related Activities.
Certain Providers may, entirely at their own discretion, offer activities involving plant medicines, psychedelics, or other controlled substances (e.g., ayahuasca, psilocybin). Such offerings are not affiliated with, endorsed by, condoned, supported, or facilitated by ANANDAYA. Guests knowingly and voluntarily assume all medical, legal, or other risks associated with any substance-related activity.
6.5 Assumption of Risk.
Guests acknowledge that wellness retreats and related activities carry inherent risks — including, without limitation, personal injury, illness, property loss, travel disruptions, or financial loss — and voluntarily assume all such risks.
6.6 Release & Waiver.
To the fullest extent permitted by law, Guests release, waive, and forever discharge ANANDAYA and its officers, directors, employees, and agents from any and all claims, causes of action, damages, losses, costs, or expenses (including attorneys’ fees) of any kind or nature — whether direct, indirect, incidental, special, consequential, exemplary, or punitive — arising out of or in any way connected with: (i) the acts, omissions, products, or services of any Provider; (ii) participation in any retreat, activity, or service; (iii) any interaction between a Guest and any Provider, including booking, payment, communications, or dispute resolution; or (iv) travel to, from, or between any retreat or destination; or (v) any chargeback, payment-processing failure, or currency conversion discrepancy.
6.7 Indemnification.
Guests agree to defend, indemnify, and hold harmless ANANDAYA from and against any third-party claims or demands, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or in connection with a Guest’s acts or omissions, including participation in any substance-related activity.
6.8 Maximum Liability.
If, notwithstanding the foregoing, ANANDAYA is found liable for any claim, ANANDAYA’s aggregate liability to any Guest shall not exceed the greater of (i) USD 100 or (ii) the total commission actually received by ANANDAYA in connection with that Guest’s booking.
6.9 Non-Excludable Liability.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot legally be excluded under applicable law.
6.10 Severability.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
7. Booking Formation
A booking is confirmed when the Guest’s payment is successfully processed via Stripe. The resulting contract, including all obligations and liabilities, is solely between the Guest and the relevant Provider; ANANDAYA is not a party to that contract.
8. Payment Processing & Commission
ANANDAYA collects guest payments via Stripe as the Provider’s limited payment collection agent. After deducting its commission, ANANDAYA remits the remaining amount to the Provider per the agreed payout schedule. Payment to ANANDAYA is deemed payment to the Provider. ANANDAYA has no liability for Stripe errors, delays, or chargebacks. Payments are processed through Stripe, a PCI DSS Level 1 certified service provider, and Guests agree to be bound by Stripe’s Terms of Service and Privacy Policy when submitting payment.
9. Fees & Non-Refundability of Commission
Platform or service fees, including ANANDAYA’s commission, are non-refundable except as required by law or expressly provided in the Provider’s written cancellation policy.
10. Provider Cancellation, Refund & Facilitation
10.1 Provider Policy Controls.
All deposits, balance-payment schedules, and cancellation or refund terms are established solely by the Provider and disclosed at the time of booking. The Provider’s policy governs any refund, credit, or cancellation right, and may designate some or all payments as non-refundable.
10.2 ANANDAYA’s Limited Role.
ANANDAYA acts only as the Provider’s payment collection agent. Any refund — if and only if authorized under the Provider’s policy — is funded exclusively by the Provider and processed via Stripe back to the original payment method. ANANDAYA bears no obligation to issue refunds from its own funds.
10.3 Post-Check-In Matters.
ANANDAYA is not responsible for the delivery, quality, or changes to any Experience. After the retreat has commenced, all service issues, quality concerns, or requests for compensation are strictly between the Guest and the Provider. ANANDAYA may, at its discretion, forward communications but assumes no responsibility for resolution, credit, or refund.
11. Chargebacks & Card Disputes
Guests agree to contact the Provider first to resolve any dispute. If a Guest initiates a chargeback that is denied or deemed unwarranted, the Guest is liable to ANANDAYA for any resulting fees or costs. ANANDAYA is not responsible for card-issuer or payment-network decisions.
12. Taxes
Providers are responsible for all applicable taxes on their Experiences. Where required by law, ANANDAYA may collect and remit such taxes on a Provider’s behalf, without assuming any liability for the accuracy or sufficiency of the amounts collected.
13. Force Majeure & Travel Insurance
13.1 Force Majeure.
Neither ANANDAYA nor any Provider is liable for failure to perform due to events beyond reasonable control—including natural disasters, pandemics, governmental actions, or travel bans. The sole remedy for force majeure cancellation is refund of any amount not yet remitted to the Provider.
13.2 Insurance Recommendation.
ANANDAYA strongly recommends that Guests obtain comprehensive travel and medical insurance to cover unforeseen circumstances, including trip cancellation and medical emergencies.
13.3 Guest Travel Responsibilities.
Guests are solely responsible for (a) booking their own travel to and from the retreat location; (b) ensuring that they hold adequate travel and medical insurance; and (c) complying with all visa, vaccination, and health-entry requirements for the destination country and any transit countries.
14. Entire Agreement and Survival
These Terms constitute the entire agreement between ANANDAYA and any Guest regarding the subject matter herein and supersede all prior understandings. Sections 6 through 13, 16, and this Section 14 survive any expiration or termination of these Terms.
15. Changes to Terms and Conditions
We reserve the right to update these Terms and Conditions at any time. Any changes will be posted on this page with a revised effective date.
16. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles. The parties agree that the state and federal courts located in New York County, New York, shall have exclusive jurisdiction to settle any such dispute or claim, and each party irrevocably submits to the personal jurisdiction of those courts.

We at ANANDAYA are committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard your information when you visit anandaya.co, subscribe to our newsletter, or book a retreat through our platform.

Booking information — full name, phone number, accommodation preference, and any dietary or medical notes you choose to share so the retreat host can accommodate you.

We implement appropriate technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. Stripe is PCI DSS Level 1 certified, and all data in transit is encrypted using TLS.
4. Sharing & Disclosure of Information
We share personal data only with (i) Stripe for payment processing; (ii) retreat hosts for booking fulfillment; (iii) service providers who support core site functions (e.g., hosting, email), each bound by confidentiality; or when required by law.

6. Cookies and Tracking Technologies
The website and Stripe place only strictly necessary cookies that enable core functions such as page security, load balancing, and checkout sessions. These cookies do not track your browsing behavior. You may block them in your browser settings, but some features (including checkout) may not work.
7. Lawful Basis & Retention
We do not sell your personal information. We process booking data to perform our contract with you (GDPR Art 6 (1)(b)), and newsletter data with your consent (Art 6 (1)(a)). Booking data is kept for the duration of the contract and for tax or legal obligations (typically seven years). Newsletter data is retained until you unsubscribe.
